Investigate
Before initiating action of any type, each case is thoroughly reviewed and investigated. Investigation begins with due diligence review of all policy documentation
and prior collection activity. Once all legally responsible parties have been identified, background information is compiled from available public records and credit reporting agencies to evaluate the legal structure of businesses, assets/liabilities and bank/creditor relationships. This analysis of policy documentation and background information is invaluable during our attorney's initial payment negotiations, dispute resolution and suit evaluation.

Negotiate
With the above information in hand, payment demand is then made upon the debtor. The insured is given the opportunity to present evidence of disputes, cash flow problems and a position regarding payment of the premium. If the insured has a seemingly valid dispute, relevant evidence is obtained to enable our client to quickly validate the dispute and adjust the debt. The result of our attorney's negotiation is generally immediate payment in full or establishment of reasonable repayment terms. If negotiation identifies issues that might thwart successful litigation or prompt a counterclaim, a compromised settlement may be recommended in lieu of protracted litigation.

Litigate

If negotiation clearly determines that the insured is financially capable, yet unwilling to resolve the debt, suit action may be initiated to enforce collection. However, litigation is considered only if all negotiation efforts have been exhausted, documentation is deemed sufficient to present the case in court and potentially attachable assets have been identified. Due to the effectiveness of our collection approach, litigation is only required on fewer than five percent of all cases assigned and never without the expressed authorization of our client.
